a disturbing case of alleged abuse caught on camera, tonight a house manager is accused of abusing an intellectually disabled man in a group home in columbia, maryland. the attack videotaped and posted on youtube. no one worker is charged and police want to -- now one worker is charged and police want to talk to the others. maureen umeh with the details. >> the tape shows the victim trying to defend himself while people recording the video can be heard laughing in the background. tonight that house manager is charged with multiple counts of assault and reckless endangerment. we want to warn you. some of the video is disturbing. howard county police say that 57-year-old donna everett seen beating a 53-year-old is protect wally disabled man. everett is seen -- intellectually disabled man hitting him in the head, face, neck and spitting on him while people recording the video laugh and encourage more. it happened in the home owned

by emerge inc., a nonprofit organization that serves individuals with developmental, physical and mental disabilities. police say the organization reported a video was brought to their attention showing an emerge employee assaulting a person who lives in one of the residential group homes in columbia. the nearly 13 minute video was posted on youtube. it shows the man and another resident identified as a 41- year-old woman with disabilities arguing. then the woman repeatedly attacks the man. as the abuse continues, everett is seen and heard taunting and encouraging the woman to assist in beating the man. >> hit him. he hit me in my stomach. >> reporter: the man is seen trying to defend himself while people recording the video can be heard laughing in the background. no one comes to his aid or tries to stop the abuse. it is not known if the people involved in making the video are employees or residents of the group home. police are working to confirm their identity. the edge n the district

and worries about healthcare, nurses in our area say there is a serious shortage of critical care nurses. they're so worried they want the d.c. council to pass a law mandating how many patients each nurse can care for. fox 5's matt ackland explas why that kind of law would be expensive for hospitals. >> patients over profits! >> reporter: packing d.c council chambers, a huge group of nurses rallied in support of legislation called the patient protection act. act. >> across the district patient safety is regularly threatened because hospital corporations refuse to ensure that there are enough registered nurses working at the bedside. >> reporter: these nurses say something has to be done now. they are spread thin, overworked and face burnout. they worry patients aren't getting the attention they need. >> when the hospital is short staffed, we just can't do our jobs right.

it's wrong. it's dangerous. it doesn't make sense. >> reporter: so far nine council members have signed onto legislation to set up a nurse to patient ratio, protect whistleblowers and do away with mandatory overtime for nurses. >> you don't want your loved one to be in the hospital and be in a very critical moment and there's no nurse available. >> reporter: at the d.c. hospital association there are concerns about the effect of this legislation. president robert molson wouldn't be specific but said a discussion should take place outside the political arena. >> this is one market in three jurisdictions where d.c., but maryland and virginia are very nearby. it's not on their radar screen. they're not considering it and we all do the best job we can. >> reporter: even district leaders understand this legislation could drive up costs and drive down profits for medical centers, but if it improves patient care, for now they're standing behind it.

[ cheering and applause ] ] >> reporter: even with nine of the 13 council members already showing support for the legislation, it's still not a done deal. there are public hearings to be held before a final vote is taken. in the newsroom matt ackland, fox 5 news. with just over a week until valentine's day smash and grab at a virginia jewelry store, four men demolished a glass display and got away with the jewelry inside. fox 5's lauren demarco joins us with the details. >> it happened at the fashion mall in pentagon city earlier today. you can clearly see four men wearing hoods walk into zales jewelry store. at least one suspect is armed with a hammer and begins smashing away at the glass. the others help peel it back and all four grab what they can. they made off with 27 diamond rings, estimated value $128,000. after grabbing the rings the

suspects took off running for the nearest exit. it led to the top level of the parking garage where there was a get-away driver in a red sedan. they drove through a closed gate exiting onto 15th street. investigators are checking security cameras in the garage to see if they can get a better description on the car or tag numbers. >> it's pretty scary because you come to the city thinking there's security and there's security all over the mall. so that is pretty gutsy on their behalf. >> they did conceal their identities by wearing hoods and i don't know if it's masks, but they did conceal their faces. so maybe through clothes the public will be able to help us locating these individuals. >> this happened around 11 a.m., so the store was open for business, but no customers or employees were hurt. if you recognize the men or have any information about the incident, police want to hear from you. now a developing story in alabama, after seven days a

hostage standoff has come to an end. the 5-year-old held captive in an underground bunker is free. the man who kidnapped him is dead. fox's craig boswell joins us live from midland city with the latest. >> reporter: good evening to you. agents said they felt like this the boy's life was in imminent danger. they stormed this bunker around 3:00 local time plucking this 5- year-old out of this homemade bunker that is maybe 5 feet underground ending this captive drama that has been going on now for seven days. a dramatic conclusion to the hostage situation after fib agents stormed the alleged gunman's bunker this afternoon. >> within the past 24 hours negotiations deteriorated and mr. dykes was observed holding a gun. at this point fbi agents fearing the child was in imminent danger entered the bunker and rescued the child. the child appears physically unharmed. the subject is deceased.

>> reporter: the little boy who turned 6 years old this wednesday was sent to a local hospital. >> very special child. he's been through a lot. he's endured a lot. just by the grace of god he's okay. >> reporter: it remains unclear how the gunman, jimmy lee dykes, died. bomb technicians are working at his property looking for improvised explosive devices. the 65-year-old allegedly shot and killed a school bus drive before kidnapping the child last tuesday -- driver before kidnapping the child last tuesday, the day before he was scheduled to be in court for shooting at his neighbors. some say he once beat a dog to death with a lead pipe and paroled his yard at night with the bus driver has been hailed as a hero protecting 20 other children on the school bus. earlier today the sheriff in dale county told us the suspect had some type of a complicated

story that he wanted told. it's unclear now whether the story ever will be told or whether we will find out the motive for this crime and citing an ongoing investigation they declined answering questions a little less than an hour on how the suspect died. this area behind us, they're still searching for bombs thinking there may be some improvised explosive devices. they think they'll be on this land for some period of time. >> do we know how the authorities managed to fish that camera in the bunker to see all this happened and make this instant decision? >> reporter: right. think about this. they have been communicating through a 4-inch pvc pipe, a ventilation hose basically that stretched several feet from the base of his driveway down into this bunker. they had said earlier a few days ago that they had some type of visual contact that they could see this gentleman. i guess that's how they saw this gun. so that's one of the things that we'll certainly want to

know detail on how they were determined at that moment that this was the time to go after seven days. >> craig boswell, live in midland city, alabama. president obama traveled to minneapolis to spotlight his hopes for new stricter gun laws. he chose that city because gun- related injuries are down 40% in minneapolis credited at least in part to a series of youth programs. still a tough sell to the staunchest supporters of gun rights. >> we don't have to agree on everything to agree it's time to do something. the vast majority of americans including a majority of gun owners support requiring criminal background checks for anyone trying to buy a gun. >> it's a fraud to call it universal. it's never going to be universal. the criminals won't comply with it. they could care less. >> senate majority leader harry reid said he's willing to look at new laws and federal traffic regulations. he voted against the previous assault weapons ban and has a

another crackdown on texting while driving in virginia is racing through the statehouse. the senate committee endorsed the legislation today to make texting while driving a primary offense with a $250 fine. full senate is expected to vote on the bill tomorrow. a house in and delegates committee has endorsed similar legislation. shawn yancy has your fox 5 top five. >> up first tonight, brian, the cost of filling up going up. no.

5, the national average for a gallon of regular jumped 13 cents in january. the rise in gas prices is being fueled by a number of factors including rising crude oil prices and low supply. a gallon of regular costs 3.70 in d.c., 3.54 in maryland and 3.41 in virginia. no. 4 hold off giving your kids energy drinks. according to the junior of pediatrics energy drinks contain high unregulated amounts of caffiene and other stimulants that enhance the effects of caffiene. the high caffiene content can cause cardiovascular problems, anxiety and insomnia. no. 3 good food at a great price. more than 200 restaurants offering two course lunches for $20.13 and dinner for $30.13. reservations are suggested. some restaurants are extending those deals an extra week. no. 2, metro is working to replace three of six escalators at

pentagon station. the south side escalators on the left as you exit are affected. you can still use the north side entrance escalators. the project is expected to wrap up this fall. no. 1, get ready to put the pedal to the metal. maryland officials are raising the speed limit on the intercounty connector from 55 to 60. the decision was made after looking at results of an engineering and crash study. the increase takes effect next month and that's tonight's fox 5 top five. who is hungry for a midnight snack? mcdonald's going mini with new bite size fish mcbites kind of like nuggets made from fish. you can get them in a kid size happy meal or regular menu with adult size portions. pizza hut has also debuted new snack size mini sliders. kind of fizzled out tonight. >> yeah. this didn't do too much. we weren't expecting a lot.

we thought it might squeeze out a coating, but the dry air was just too much for it. so a few spots north and west towards hagerstown got a small accumulation. the rest of us won't see anything. just clouds tonight and not much for snow lovers. we are still waiting for our first inch of snow on reagan national even as we come up on the anniversary three years later of one of the biggest snows we had in d.c., february 5th and 6th in 2010, a lot of places got 25, 30 inches. this clipper really did fall apart. we'll show it to you on sentinel radar. this will look a lot more dramatic. it's a combination of multiple radars. the back edge is east of d.c. that will not make it across the mountains. the system had a little trailing moisture down into the deep south, but that's not holding up either. tomorrow night there might be a

little one coming by but not impressive losing the term very loosely as this one, but frostburg got 5 inches of snow out of it. cumberland, maryland 3 inches, bayard, west virginia just under .1-inch of snow. those are areas that do have winter weather advisories because there might be a small accumulation on grassy surfaces, maybe untreated roads, but out in the mountains is where the snow stuck to things and where the cold air resides. we'll see a trend change this week to a warmer trend. the cold air that has allowed multiple weak waves of low pressure or clippers to come through will be ending, maybe one more and then we'll watch some of the mild air that's been residing to the south and into the west start spreading this direction. so we're thinking it will be 50s for the weekend and maybe a couple rain showers here and there. that will be about it. 32 degrees at this hour. we've got frederick down to 32,

hagerstown colder with snow at 28 degrees, but in the district 37, quantico 38, not bitterly coal. we'll probably stay right around 30 -- cold. we'll probably stay right around 31 degrees in the city. for tomorrow and also checking those snowfall amounts again any accumulation we would see would be well to the north and even the dusting to 1/2-inch likely won't happen with the exception of those northern and western areas. quick look at futurecast so you can see we might still see a few flurries tomorrow, nothing of great significance. we'll keep an eye on rare. sometimes the little batches can put down a small coating that makes it kind of slippery. of that goes by it looks like a couple days of sunshine and comfortable temperatures. average high is 42 degrees. 31 tonight, 44 tomorrow, a little sunshine here and there, maybe a pass of a flurry in the afternoon in the no big deal

category. at 8 a.m. 33, by noon up and over 40 in most places and by 4:00 44 degrees. a quick look at temperatures, you'll notice it stays colder where there might be a bit of snow tomorrow on the ground, not anything additional. 44 d.c., 43 quantico, 47 fredericksburg. 46 on wednesday, looking like a decent day, a couple passing flurries late tomorrow, not a big deal. could be a few showers on thursday then we head into the weekend with sun saturday, 50 degrees on sunday, maybe a few showers on monday, 54. starting to look like a spring forecast as we look down the road. scott, what's there to talk about now that the super bowl is over? i'm sure you've got something. here's his report. >> a lot of basketball for you, the wizards still without the services of guard bradley beal against the clippers but maybe more important the clippers
